Walkry Mobile Application

By downloading, installing, or using the Walkry mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Walkry ("we," "us," or "our") regarding your use of the Walkry mobile application. By using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Walkry is a fitness and wellness mobile application that helps users track their walking activities, set fitness goals, and engage with a community of fitness enthusiasts. The App provides features including:

  • Step counting and activity tracking
  • Goal setting and progress monitoring
  • Social features and community engagement
  • Health data integration with Apple HealthKit
  • Premium features and in-app purchases

3. User Accounts and Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Transmit or upload any content that is harmful, threatening, abusive, or offensive
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Use automated systems to access the App without permission
  • Share your account credentials with others

5. Health and Fitness Data

The App collects and processes health and fitness data to provide personalized fitness tracking services. This includes:

  • Step counts and activity data
  • Location data (with your consent) for route tracking
  • Health metrics integrated from Apple HealthKit
  • User-generated content and preferences

You acknowledge that health data is sensitive information and consent to its collection and processing as described in our Privacy Policy.

6. Data Storage and International Transfer

Walkry uses Firebase, a Google Cloud service, for data storage and processing. This means:

  • Your data may be stored on servers located outside your country of residence
  • Data transfers may occur across international borders
  • We implement appropriate safeguards to protect your data during transfer
  • We comply with applicable data protection laws and regulations

7. Premium Features and Payments

The App offers premium features available through in-app purchases. By making a purchase, you agree to:

  • Pay all applicable fees and charges
  • Abide by Apple's App Store terms for in-app purchases
  • Understand that purchases are generally non-refundable
  • Accept that premium features may change or be discontinued

8. Intellectual Property

The App and its content, including but not limited to text, graphics, logos, and software, are owned by Walkry and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer or attempt to extract source code
  • Use our trademarks or logos without permission
  • Create derivative works based on the App

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers and Limitations

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Termination

We may terminate or suspend your account and access to the App at any time, with or without notice, for any reason, including violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or other appropriate means. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App will be resolved through appropriate legal channels.
